Even if they've won the appeal, it was only against the injunction. The case has not yet been to trial.
It's quite common for the Court of Appeal, if it has heard extensive argument on an appeal against a refusal of permission to appeal, for example, to roll the process into one and determine the appeal on the spot. After all they listened to all the legal arguments on Tuesday. Just a repetition to hear it all again.
