Even if they've won the appeal, it was only against the injunction. The case has not yet been to trial.
I find this very strange. It was only listed for a judgment on the application for permission to appeal.

No. An interim injunction is just that - an interim remedy based on a preliminary assessment of the merits - and the claim will go to trial if it sought any final remedy (e.g. damages against the Union).
