Sorry ..... but you are stretching the point by suggesting that EU law is made up by my elected representatives.
I am afraid they accepted the international treaty that gives legislative authority to Council/Parliament regulations such as EC261/2004. Not that I agree with such a supra-national approach, but that is a debate for another place.
