I said I wouldn't post on this topic again but I would like to use this post to illustrate one of the points in one of my earlier posts when a Doctor makes a mistake and kills someone you generally don't see the public calling for criminal charges. Even if the Doctor is white and the patient is a minority. The Doctor doesn't set out in the morning to kill someone if it happens it may just have been a human error. This police officer did not set out to kill someone it may just have been human error. It doesn’t make the outcome any less tragic. However, intent in the eyes of the law means a lot. The parties concerned have the same avenues available to them that they would if it was a Doctor that made a mistake. Yes, more than likely the officer would not have to financially pay it will be the municipality and many would argue rightfully ultimately the taxpayer. This would be no different than suing the Doctor. The Doctor's malpractice insurance would pay, the Doctor in turn pays higher premiums and we in turn pay higher medical costs.
