Actually if you take them to arbitration you will probably win. I would first sue them and make them make the election to go to arbitration.

The last post about the credit card companies paying the arbitration firms fees is not entirely correct. Mbna, boa and fia card services (all part of boa) were the ones that filed a bunch of arbitration claims against consumers for not paying their bills. 99% of these cases were filed with a company called the National Arbitration Forum, (NAF). They were actually owned in part by a large firm that bought unpaid credit card debts.

NAF is no longer is business as they have been investigated by several state attorney general's, mainly lead by Minnesota.

Amex does not file arbitration claims when they go after people for unpaid debts so I would not file an arbitration against them, I would just sue.
