Well, this is what the Commonwealth of Massachusetts Office of Consumer Affairs had to say (at least the important part):

Under state law, a merchant must tell you about any fact that may influence your decision not to enter into the transaction. A merchant also may not make a claim about a product or service that would mislead you. It's also illegal for a merchant to mislead you by failing to tell you relevant information about a product or service. For your information, I have attached our brochure on Shopping Rights.

To seek recourse in your situation, you can write Liberty Mutual a 30-Day Demand Letter. In this letter, you will need to include a description of the unfair or deceptive act or practice that has been committed, the injury you suffered as a result and the demanded relief that you are seeking. The merchant will then have 30 days to make a good faith response or it could subject him/her to triple damages and attorney's fees. For your information, I have attached our brochure on the 30-Day Demand Letter.

If anyone is interested in the full e-mail, I can forward it to you privately. I'll wait to see what official response there is before I write again. I sent a note to the Barbra Gray that was mentioned in a previous post the same time I sent this to the state and haven't received a reply from her.

Is Liberty Mutual based out of Mass? Can we all use the Mass info or do we have to go state by state.

After winning with Office Max, I am up for another battle!
