Of course people can, and often do, get away with purchasing such tickets on e-bay, just as people who buy tickets from scalpers can, and often do, get away with it as well, as was mentioned earlier in this thread.
But that doesn't make it right.
It all gets down to the principles involved. Buying an award that is not transferrable to save, say, $400 over a purchased ticket that would have cost, say, $750, is like stealing that $750 from the airline or stealing services worth $750 from the airline.
Airlines have a perfect right to set the rules by which their programs operate and rules that govern the conditions by which awards can be procured and used. We don't have to like those rules, to be sure, but that doesn't change the principles involved.
