The interesting point is why compliant carriers are not searching out mechanisms to ensure that non-compliant carriers are not leaving compliant carriers at a disadvantage. Maybe they are-but there may be some perceived inhibitions against them discussing these matters inter-se.
It's called "light-touch regulation". Not having effective means of redress for consumers and pussy-footed regulatory bodies is seen by various governments that shall remain nameless as a competitive advantage (see also: 'offshore', 'fiscal paradise', 'regulatory race to the bottom'). This is where the small claims court comes in handy...
