Unfortunately DL is far more likely to reprimand the FA for violating SOP by moving a seated passenger.

Out of my last 10 flights where I was sitting in First, I'd estimate that at least 5 took off with 1-2 empty FC seats when I know for sure that there were sufficent people on the wait list to fill those seats.

Another good reason to be Diamond in 2010.
