Afraid to say that according to the T&Cs etc they are right - noshows shouldn't get points or any nights credit (the old saying about 'bums on seats', or rather 'bums on beds' counts for Marriott). You need to go and check in to get the points/credit, in the same way as you need to take a flight to get the miles.

However, I've seen posts in the past, and know colleagues, who have got their points after a complaint. As such, just ask for consideration from the hotel/customer service, hopefully they will be generous and let you retain gold.

Alternatively (and probably a better idea), take advantage of the Marriott's rolling window status upgrades in a 12 month period.... in some ways you will be better placed if you can do a few more stays now to get 50 nights in a 12 month period as you will get;
Gold this year (2010) and next year (2011) due to status carrying forward. You will also be starting this year on 39 nights I guess due to the rollover (i.e. if you stayed 49 nights last year I believe you will get silver + 39 rollover nights), which means with another 30 or so nights you would get Platinum (rest of 2010 & 2011) and then Gold in 2012..... search around and there are many threads on the board discussing this concept.
