The agent was correct, and it has worked this way forever.

If those two seats are still unsold at the gate, passengers will be upgraded based on status/miles. They may release a portion of them as flight time gets closer, but US has always held inventory for sale in advance. I can vouch that as a CP I have indeed seen the same situation, and have no issues with it.
