i don't think that is correct. one must join “Consorzio del Vino Chianti Classico Gallo Nero” in order to display the gallo nero symbol, but it is not required to make legal chianti classico.

i thought a few years back that gallo winery brought suit against the consortium and required they quit using the name gallo in their US advertising. when we were in Radda a few years ago, the name had been changed from gallo nero to something else. it appears that now, the gallo nero name is used.
