I wouldn't have said anything because it don't really see the point to not putting it in the seatback. I've seen people use Bose headphones during take-off frequently and don't say anything because honestly what does it affect? If someone was in violation of rules which I thought really could endanger safety, e.g. blocking the exit row floor with a carry on I probably would speak up.
