I think it would be the departure date that would count, not the arrival time. Red eyes always seem to post with the departure date.
Now if a flight is delayed and now departs on a new date, does the original flight date count or the actual? I guess if that happened on Dec 31st/Jan 1st and they posted it on the later actual departure date, you could probably argue that they should award miles based on the booked dates, not the flown dates, especially if it made a difference for status. I can't see them deny you a status level based on irregular ops on New Years Eve.
