You put it very rigorously and in principle I agree. Yet in practice put the bag in front of you for take-off and landing, then store it behind your legs. I he is 6'3" that will be absolutely no problem.

Checking his briefcase is most likely not an option. I he checks the big bag, he still shouldn't put the small one in the bin because that space is better used for the big ones. So that wouldn't solve his problem.

Depending on boarding procedure he could also try to sit in the back (or wherever boards first) and see if he can get away with it but it wouldn't be very smart or social, so it's good he gets called out for it.
