Well I don't know at what point of the fight did he discover the overhead bin was rather empty. If he figured it out shortly after takeoff, he could of put it on the OB and have that free space beneath the front seat. If the crews discovered he removed it from underneath the front seat to the OB, I don't believe they'll object. Afterall that's what the OB is for.
