I guess I'll chime in...I am an attorney and do personal injury work (among other types of legal work) but only defense (before everyone goes nuts on here). There is no valid legal claim here, which doesn't mean that nobody will sue. I'm sure some knuckleheads do not have health insurance and suing may be there only way to try to get CO to pay for their medical care (and going to Jackson in Miami is a stretch to call medical care...lol). If CO can settle with them for a small amount, CO may.
Having said that, I do get annoyed at all of the rabid defenses that many on flyertalk always come up with when talking about airlines. A number of people always want to blame passengers. People do get up when they are on the plane. People have to go to the bathroom. Older people worry about DVT. Etc. etc. I always wear my seat belt when seated, and a VAST majority of people do from what I can tell. But it's a little absurd to expect people to always be seated, which is the logical conclusion of some of the comments on here. In addition, it sounds like the persons who were most severely injured were the FA's?
