Unfortunately when the Department of Transportation reviewed the issue, their solution was disclosure that you must be told about change of gauge. As you noted, it's something all airlines do, and in fact when the concept first began in the 80s, AA opposed it.

On the domestic segment upgrade issue, that sounds incorrect.
