I hate rehashing this topic from several months ago - but I will say that unless USAir had ZERO bird strikes in the past, then a bird strike is something they should reasonably expect and plan for. I seriously doubt USAir has had no bird strikes in the past.
So saying they had ZERO control over is disingenuous - they knew it could happen (because it has happened in the past), and chose not to implement any precautions against it happening.
I came up with this in 5 minutes of thought, and I'm nowhere near a lawyer.
So let me repeat - I think paying for therapy for people who you helped to have a near-death experience is not unreasonable. Believe me I understand she should be thankful that they did not die. And so is USAir, because they would have paid a LOT more than $5000 per person if there had been any deaths.
