I'm not so sure I 100% agree with this. I think that lawsuit abuse does cause higher premiums in addition to what you mention. Look at physicians who are leaving certain states. They are leaving because malpractice insurance is way to high for them to afford. The reason it's so high is because of the increase in malpractice suits in that state. Perhaps I'm not comparing completely equal things here but I would think there has to be some merit to it.
Look, it sounds completely reasonable that runaway lawsuits (or successful lawsuits) are the cause. But, I just have never seen anything to back this up.
Every type of insurance carrier uses this same deflection for any variety of insurance to justify higher and higher premiums. Their control over policy and lawmaking is the problem. But that is another story altogether.
