I have that card too (I live in Canada though) and I recently got a notice from BoA stating that they were going to start charging the foreign exchange fee for "all foreign purchases" even those that were billed in US $. Perhaps that's the issue.

Foreign transactions fees are fees that may be assessed when you use your Credit Card to make a transaction that requires a conversion of currency. Any transaction processed outside of the United States (even if the transaction is in U.S. Dollars) will also be assessed a foreign transaction fee. You may incur this type of fee when you make a purchase either in person, over the phone or online with a merchant in a country other than the United States.

Since you are now often offered the choice of paying in your 'home' currency or the 'local' currency when traveling abroad, I guess the banks have found a way to get their Foreign Exchange fee no matter what.
If the banks here start that, I won't be selecting the option to pay in my 'home' currency anymore. There's no way I'm going to pay an exchange fee at the time of purchase to buy in my home currency and then again by my home bank for charging something in CAD outside Canada.
