The State of Indiana prohibits the use of hand-held radio scanners outside of one’s home or place of business (scroll down to IC 35-44-3-12) but is open to very selective enforcement. These devices are very popular at venues like the Indy 500.

Even if this happened in, say, IND the TSO still overstepped the bounds of what he should be doing.
