BUT real problems arise if there is an accident. If you obtained the car rental having knowingly lied to the agency, you could be in major trouble if you are involved in an accident-- and, as we are all aware, accidents here can be VERY expensive. Any decent attorney for the insurance company or car rental agency is going to find out about your UK conviction, and will use that to void the terms of the contract between you and the rental car agency and/or insurance company, and you could be fully liable for the accident. This includes damage and loss of the car--so if your car is stolen, and insurance would have covered it, they could use the non-disclosed DUI as an excuse to refuse payment. I would never wan to drive in the US knowing that I could be fully responsible financially for an accident/loss/damage--it is very, very expensive here.
To this point I hold both a UK and US drivers licence and when I first moved to the USA I would use my UK drivers licence when renting cars and my US one when driving my own car. I got pulled over by the WSP on I-5 in Seattle and produced my UK licence, the officer went back to his car and came straight back and asked me "Do you have your CA drivers license?". He then gave me a ticket, a big telling off and said I could be prosecuted for obstructing justice! So I now never use my UK licence.

The rental agencies however only seem concerned with the driving history of the licence that you present, I had 9 points on my UK licence (speeding) and had trouble renting a car but they didn't care once I had my US licence.
