does not violate the agreement,
neither does refusing the sale because you feel the person handing you the card may be a crook. I have been down this road with Visa on more than one occasion. We never lost our merchant account, never had a fine levied and never had a chargeback due to fraud.
BUT if you do not like the terms of the deal, be smart and walk away. Not only will it save you aggravation it saves the business the aggravation of dealing with a customer that they can't please.
