One way would be for CP's who buy tickets 3 days prior to departure. Gold would get the upgrade at the 3 day window before the CP bought the ticket. If the Gold got the last available upgrade seat, the CP is out of luck, possibly even so on a Y-Up type fare. Not that US F is selling out much these days.
