I can only imagine that it has not become fully mandatory yet?
ESTA is mandatory (from 12 Jan). However they have backpedalled on removal of I-94W. Originally touted as going from 12 Jan (one reason why ESTA was voluntary before 12 Jan was to test the systems), now it is merely planned to be removed in future - no date or criteria specified. So for the foreseeable future we need both an ESTA and an I-94W.
