The city is requiring calorie counts on menus. They have not been able to enforce the accuracy of those numbers.

This if from the Tasti Delight fiasco years ago

New York City frowns on deceptive advertising. ''If the lab tests are correct,'' said Dena Improta, a spokeswoman for the Department of Consumer Affairs, ''yes, it is a violation of the deceptive advertising law.''

But the agency has said it does not have enough inspectors to pursue a matter that is not an immediate health concern. In any event, both soft serves, which are made primarily of water and skim milk, certainly have fewer calories than Häagen-Dazs, and even those who don't think much of the taste say they believe they are better for them.


Remember back when Tasti Delight and others said their cups were fat free with 40 calories, but the NY Times did tests showing it wasn't fat free, and contained as much as 224 calories.

New York City is at a total loss to enforce any health regulations at restaurants, and the restaurants know it. Thats why Pucks can tell you that pizza has as many calories as two bananas and an apple
