Perhaps an attorney can chime in on this. The CoC defines the service CO provides as transporting a passenger from point A to point B. Why not re-write the CoC to define the service as providing a certain amount of space on flights from point A to point B?

An economy ticket includes only a small amount of space whereas F or BF includes larger amount of space. Anyone in either cabin desiring more space may purchase it at additional cost.
