How so? The recording is the intellectual property (copyrighted) of the person who took it. What gives the airline the right to take and destroy that property? Sure, they could sue to take possession of that property or they could deny the passenger passage on any remaining segments of the ticket.

Hmm...thanks for the info. I had assumed that if you weren't supposed to be taping they could tell you to delete what you shouldn't have taped in the first place. Definitely good to know since I travel with my camera.
