I've tried both holding it, and just letting it lie there (and it is touching me). The holding was just a test, but I do expect that to have some negative impact- I was just trying different options to make it work.
I bought it from OneSaleADay (from a thread here), so the warranty option is pretty slim, even if it is defective

I'm hoping that they'll be the kind of company that may replace it anyway, with full disclosure of where I got it. If not, a number of other companies make reliable products that will certainly outperform the particular unit I have.
Oh yeah, and a second ear loop just broke yesterday, even though I have it in a case. I think this item was just not makde for me
Edited to add: Well, I just called CS at Aliph. He asked wehre I'd purchased it, and I told him it was a non-Aliph website. He asked about the packaging (to make sure that it was a standard item, I'm sure) and said that they will swap it out for me. No questions about the specific site. I had a feeling that they'd do this, and their CS is impressive so far.
