Could be. The airline still acted based either on some secondary obligation of the orginal contract or agency of necessity for the deceased person. But certainly not the other pax. For them is the same fate as being stuck in a traffic jam (you cannot hold the person causing the jam liable (at least in my jurisdiction))....
