dgolding was saying that a disruptive passenger or a violent passenger should be dealt with using existing legal systems (e.g. criminal courts). These have defined procedures, certain guarantees of fairness to citizens caught up in them, etc. A fine of thousands of dollars that can be contested in Coast Guard court (!), in contrast, is a very foreign enforcement mechanism.
In the case you mentioned, that person would have the chance to tell his story to a jury.
