I saw a guy try this on a SFO-SAN flight about 2 months ago. When the FA asked him to move, he argued that he was owed an upgrade or something. After two more requests from the FA, he did move. BUT, when we landed in SAN, the police met him on the jetway. I don't know if he was arrested or not.

It seems to me the FA's have a passenger manifest for all flights, and usually adress me by name in business or first.
