It's a statement illustrating the principle, not one comparing surcharges to murder. Does not matter how you slice it, you cannot circumvent the law.
The difference is that murder is specifically defined as illegal by law in most or all countries. This has yet to be decided by courts for fuel surcharges on award tickets, in various countries.
