I think you miss an important gem in Skeletor's second quote, Spiff. He's essentially admitting that the haraSSSSment lists and No Fly Lists are illegal and wouldn't stand up to a court challenge.
I'm glad I'm not the only one who read it that way. I can't imagine it is what he intended to mean, but maybe a Freudian slip?
