No, gift cards can very well be non-refundable, as long as they contain no expiration date. If they expire, then they must be refundable to the purchaser after the expiration date.
Given that most major national retailers offer gift cards, I don't think the variations in state law are the barrier to UA doing so. I don't know what that barrier might be, but I doubt state law is it.
