The most annoying thing is at no point would anyone give me a refusal. They simply said my offers were, flight within 21 days, refund, or pay a fare difference to move. No one ever explained why they thought EC261 didn't count in this instance nor why they were going against the wording on their website

No, but the steps will be the same.
You've actually done steps 1-3
Just need to get back to Virgin and tell them you will go to CEDR as a next step. and ask THEM what documentation they have to progress this
They have a Complaints page
Also their version of EC261.
With this bit
take an alternative flight to your destination, under comparable transport conditions and where seats are available, at a later date

Couldn't you take the refund and either gamble on prices coming down for the Autumn flights (surely likely if they are Ł3K), or do an ex-EU to bring down the cost if they don't drop ex-LHR?

I've recently gone down the MCOL route with them. They didn't respond to the court papers so I've got a default judgment against them. They've got a few more weeks to pay or face bailiffs or high court enforcement officers. Seems very Ryanair-esq to let things play out this way, I'm not sure why they think a default judgment best serves their future.

I see this is operated by Delta so this may make a difference.
