New UK Passport.....Visa Question
 
Hi all. I have recently had my passport replaced due to expiry. Held on my old passport (which i have also received back along with my new one) are an L1 US Visa and an Indian Multiple entry business Visa, with 5 years and 9 months remaining on them respectively.

My assumption is that i have to carry the old passport, containing the Visas, with me along with me new one? Does anyone know if this is correct?

I am slightly concerned as my new passport naturally has a different number to the old.

My old passport has already expired. My visa to travel to the United States is still valid but in my expired passport. Do I need to apply for a new visa with my new passport?

No. If your visa is still valid you can travel to the United States with your two passports, as long as the visa is valid, not damaged, and is the appropriate type of visa required for your principal purpose of travel. (Example: tourist visa, when your principal purpose of travel is tourism). Both passports (the valid and the expired one with the visa) should be from the same country and type (Example: both Uruguayan regular passports, both official passports, etc.). When you arrive at the U.S. port-of-entry (POE, generally an airport or land border) the Customs and Border Protection Immigration Officer will check your visa in the old passport and if s/he decides to admit you into the United States they will stamp your new passport with an admission stamp along with the annotation "VIOPP" (visa in other passport). Do not try to remove the visa from your old passport and stick it into the new valid passport. If you do so, your visa will no longer be valid.


The first hit when googling "India visa new passport" links to the VFS visa application service page which seems to suggest you need to have it transferred, but isn't definitive

Transfer of Visa could be done from the old passport to the new passport for any visa issued by the HCI/CGI. Applicants are required to submit the new passport and old passport which holds the valid Indian Visa. There should be a minimum validity of at least Three Months on the day you submit your application.

Basically as long as both passports are issued by the same country and the visa hasn't been damaged in any way (it's fine for the corners of the passport cover pages to be cut), you're good to go. UK passports always have a different number when a new one is issued. Just carry your I-797 and you're golden.

If you applied for a new visa the consular officer would just say you're wasting your time and money.
