Couldn't find this being discussed anywhere on FT.

The story

The names on this lawsuit are quite interesting; several will be recognizable to established FTers.

I have mixed feelings on this lawsuit. Very curious as to what others think.

The firms mentioned in the suit are Fogelman & Fogelman of Newton, MA and Rishwain Law Group of LA.

I'm sure it is an ambit claim which if successful would set an interesting precedent. I'm not sure they have high expectations of being successful; I suspect their representatives are not from particularly major firms.

But it's high time merchants' refusals to honor published bonus offers (whether a poorly designed offer blows up in their face, or due to incompetence or just plain dishonesty) got litigated.

As for the airlines, they're displaying the same two-faced behavior they show when promoting codeshares or regional affiliates. Happy to splash their brand on everything until something goes wrong, then they claim they have nothing to do with it.

IMO, I don't see this case going very far, but just getting this into court and letting people know how the airlines are taking miles away from frequent fliers is a victory already.

Considering the lead plaintiff, I would think there could be conflicts of interest in discussing this case on MilePoint. Thus I started this thread. But definitely good to read the summary over there.

Not really... It's one thing to use a "mistake", but it's quite another to abuse it first (in an unsurpassed way) and then to sue. Probably to extort some kind of settlement.

Shows exactly what kind of person you really are in my opinion.

clearly you & I do not see this issue the same way.

Somehow you've made these people out to be nefarious in nature by the magnitude with which they tried to use a promo that was offered. They didn't create the promo or do something illegal (as I read it).

I'm not sure how someone that uses a 'mistake' is a better person.

I can't agree with you but don't ask me why....this is a big can of worms. What is legal and what is right it seems do not always match !!
