Duty free on cancelled flight?
What happens if you buy duty free, board your flight and it's cancelled after boarding? How does the airline/customs/duty free company ensure that things are returned or taxed?

In Canada, the official answer from CBSA is:
"Where the traveller is unable to depart from Canada, the licensee [duty-free shop] may accept the return of goods and provide the necessary monetary or credit refunds. If the goods were opened and/or partially consumed and the licensee does not or cannot accept the returned goods, the traveller must pay the applicable duties and/or taxes to the CBSA." And: "In the event of a flight cancellation or passenger emergency, the air carrier must notify the on-site customs superintendent. Arrangements will then be made for either payment of duty and taxes on duty-free purchases, or the temporary storage of the goods for delivery to the passengers when their flight leaves." Realistically, at larger airports where they have bigger issues to deal with, there is a good chance you would be allowed to keep the items without worrying about duty/tax. |

I've never been in the situation personally, but I know of plenty of people who have not been allowed to keep their duty free when their international flight was cancelled and they needed to go back landside.

I did take a bump in AMS one time when I had bought duty free, but never actually took posession of it since they take it to the gate for you. After KLM processed my cash payment (^) and rebooking for the next day, I went back to the duty free store where they already had my refund processed.

Was on a flight to the US from NRT that has to return due to an engine issue... Japan customs was asking for all duty free purchases to be turned in for a refund or to be held at the airport for the next days flight.
The duty free staff was at the gate for the flight the next day handing out the returned items. |

This happened to me on a flight once. We were taken through normal arrival channels and were instructed to return our purchases to the duty free store, where we were fully refunded before returning landside. An HM Customs Officer was lurking in the general vicinty, presumably to make sure that everyone complied.
Note that this was in EDI where the duty free shops are located in an area that's accessible to both arriving and departing passengers (you need to show your bp to make a purchase). |
While forcing people to return items makes sense in a legal way, it's a bit crazy. The cost of doing so probably outweighs any revenue lost. If cancellations like this were foreseeable, then it would be necessary to require returning the items.
