EU261 and Tui Premium Club downgrade
 
A friend has just got off a flight with Tui from Orlando. He had booked into Premium Club seats but due to an aircraft change these were not available.

Can Tui argue that these were economy seats with extra legroom and deny EU261 downgrade payment?


Apparently, Tui was pretty awful, crew unhelpful and obtuse, and dropped cup of hot tea on his daughter's lap.

It appears that these seats are sold as an add-on: https://www.tui.co.uk/destinations/info/travel-options/

As such, it appears that there is no real downgrade (not a separate cabin) but they should at least get the cost of the add-on refunded.

Thanks IrishGuy, helpful as always.

Having checked the ticket it appears that the higher rate of APD is charged which suggests that legally this was a higher cabin so it may be worth trying.

Yes, you can claim a 75% refund; even through court action.
