I have to agree with basejumper. This would be like saying stealing from Macy's is technically not permitted, but unlikely the sales clerk will see you if they are at the register ringing up customer's purchases.

The FAR states that the device in question is NOT permitted during taxi, take off, or landing. To even insinuate that they should try and "get away with it" is irresponsible and BAD advice.
