People, please edit/use the wiki so same questions are not always asked.

The current CTA decision on the Yangon deal is only for tickets canceled by SWISS Airlines for the seven merged complaints/companions and tickets canceled by Jet Airways for one complainant and companions
- It's not about other carriers because each carrier submits different tariffs.
- If you are not one of the complainants or their companions above who were mentioned in the respective cases, you need to submit a case yourself for hearing.
- There's currently one person who is on Iberia for CTA decision, one can either wait for results or submit a complaint to CTA.

Result of the current case for LX in brief is:
- CTA found 5(F) in the tariff used to be unclear for canceling tickets on erroneously quoted fares.
- 5(F) is unjust and unreasonable and must be revised or taken down by July 9, 2013 (or SWISS can appeal by then)
- SWISS did not use its tariff correctly to cancel the tickets.
- SWISS must compensate one complainant's First Class ticket and any related expenses by July 18, 2013 provided with evidence.
- SWISS must transport other complainants (and their companions) in the original price charged with same booking class and routing by June 18, 2014.

Result of the current case for 9W in brief is:
- Tariff on file had no clauses for "erroneous fares" and was updated subsequently, which means it is not relevant to this event
- Therefore, 9W is to reinstate the tickets with a 1-year validity for transport between the same points and the same booking class.

If you have a similar case that's with SWISS, you need to file with CTA to get a result through informal process first before it gets to formal process. The entire procedure can take up to 3 months for each and the result may not be same cause it's case-by-base and the reviewer of the case can be different.

No. Look at the chronology. Swiss filed that petition before the CTA went into the details of 5(F).

I don't understand the outcry. Swiss has the right to exhaust all possible legal means.

I think it's ridiciculous to have made this petition, that LX has zero chances and it will just cost them more in legal fees. But they have the right to do so.

Their petition should have looked like this:

Dear Governor,
Swiss screwed up
Swiss lied to the CTA and its customers
Swiss acted with incredible arrogance and disdain towards everyone involved.
However, we are Swiss, and we are always right, even when we are not. Therefore, you must vary the decision, or our ego will be irreparibly damaged.

Sure I understand they (THINK they) have a principal - but even the most principaled of airlines will bend over and take the punishment when it starts costing them too much money...

I always have bugbears when lawyers are benefitting to the detriment to frequent flyers, as I imagine is now happening.
we are way past that point and several calculations have already been made. But, we also know that this is not a business decision, but an emotional one. LX can't stand being told what to do. So they rebel. This has nothing to do with money at this point in time, but with principles, attitudes and egos.

I haven't kept up with this thread so I don't know what is going on. However, the reason LX fought this hard is because on the chance it goes their way they would have future precedent to fight these cheap fares and win. They had to exhaust all legal options just for that reason.

Exactly - if they had just honored the fare to begin with, they would have saved the laywer $$ and not have set precedence.

Now they just wasted lawyer $$, pissed off customers and have CTA tell them what they can and cannot do.

Especially if CTA forces them to remove 5F. Then they're in an even worse position, because if they have a future one, they got no phantom clause to pseudo protect them. (No offense Pseudo Nim!!)

Got an email from CTA regarding my move into the formal process

As requested, the complaint you filed on your and your wife's behalf,
as well as the statements and documents which you had already provided
under the informal process, will be transferred to the Agency's formal
process. Please note that your informal complaint (CTA Case 13-xxxxx)
will be closed. Once in the Agency's formal process, your complaint
will be assigned a new case number.

You will receive correspondence from the Agency regarding the handling
of your complaint in the formal process shortly.

So, not quite in the formal process, but LX is now aware of this complaint moving towards it per the cc line at the bottom
