I was under the impression (and am too lazy or busy, depending on point of view, to check) that the transponder fee was a daily fee that applied even if it was not used. I would be gratified to learn that I am wrong.

It all depends on the rental car agency. Some are daily fixed fee (I believe National is this way) while some are actual charge plus a small rental fee (I think Avis). Not sure how Hertz is set up. I know with Avis you have the option of turning it off with a lever that isolates the transponder.

Because it's an additional cost that can be fairly easily avoided.
