LAN fined for charging $75 change fee – Peru

LAN fined for charging $75 change fee – Peru

INDECOPI (Peru's consumer protection agency) has fined LAN S/.850.000 for charging the $75 change fee. It is illegal in Peru. As well, LAN cannot limit changes to only once. LAN is required to post on their site and refund people who were improperly charged.

The story also says the LANPeru is likely to appeal.

So why would this not also apply to any carrier that sells tickets and does business in Peru?

LAN can appeal, standard wording on these things. Yup, applies to all carriers, they too are not above the law.

Based on the wording this ruling might only be related to domestic flights sold under these conditions as endorsements regarless of paid fare etc are permitted only when travelling within Peru.

Nowhere in the ruling does it say it applies to all airlines. It is only a ruling against LANPeru.

Good point. But if Star or Peruvian or LC were to charge me this (do they?) my first stop would be INDECOPI with this ruling in hand. They have to follow the law too. Or am I missing something?

LAN's argument is that other airlines charge change fees, etc. (yes, Star Peru, etc. do charge fees for changes). So why single out LAN?!?

Must be some overzealous bureaucrat at INDECOPI that dislike LAN's Chilean parent!
