I think the letter said check timing was partly based on amount. >$1000(?) checks would ship in August and lower amounts in July I believe.

For those of you don't know - it is a serious criminal offense in California to record phone calls without notice/consent (Pen. Code § 632). A conviction can carry a significant fine and imprisonment per call. Also - it also carries a statutory damage of a minimum $5,000 per violation (i.e. per call) without any proof of injury.

That's why the settlement is generally high on this kind of cases.

Looks like it's taxable, and a W-9 will make it hard to not declare it I think. (caveat, I am not a tax professional)

I got $153, no W9 required. I got the card the last year it was offered.

Above $600 they automatically report it to the IRS. Technically I think even if it's under this amount you're still supposed to report it, but it's not automatic, so...

It is so bad that I found out now, I did not even know this class action lawsuit until I read the forum. Did FRHI or the attorney try to notify any California Fairmont membership about this class action issue? What was the damages if I called during that time? I remembered that I have called the toll fee number to arrange my Christmas stay that year, maybe several time using my account and my spouse account to make the reservations.
