There are grounds to use that would make the acquired company’s obligations — including those to the acquired company’s customer — the obligations of the acquiring company regardless of the acquiring company playing a shell game of “program dead” to try to escape standing obligations to the customers of the acquired company and the acquired company’s program(s).

What is the ultimate objective here? My understanding is that they have grandfathered in lifetime platinum status in Accor (for whatever that is worth), which frankly is the most I think one could have expected or hoped for. Now, that status is basically worthless IMHO compared to what one had at Fairmont, but that experience is true for all ex FPC Platinum members. Are you hoping for some remediation for elements that are now currently missing? Interested in what the objective outcome is.? thx

My initial gut thought was that there wouldn't be much of a chance for success, but after thinking more about it, I am reminded of a similar situation with LA Fitness originally not honoring Bally's Fitness Lifetime Member's memberships and associated perks after LA Fitness bought Ballys about 7 years ago and took over all their members, memberships, and clubs. I was very familiar with that case since I was a Bally's Lifetime Member at the time. After a class action lawsuit was filed, LA Fitness relented and now I am an LA Fitness member with all my original Bally's perks that were included with my original Lifetime membership (free kids care, wife and kids up to 18 included in the membership as I had a family Lifetime membership, etc). As GUWonder mentions, just because Fairmont is bought out and the FPC program goes away, that does not mean that the acquired company's obligations just vanish for the buyer. FYI: I just noticed on the Accor website that my Accor Plat expiry date has changed from 12/31/2019 to 12/31/2050. I assume this only applies to the 115.

Does this mean that they're predicting how long your lifetime will last? That makes retirement planning a lot easier...
