The differences in timing combined with the fact the second flight was a codeshare on another operating carrier makes it different enough from Gahan that I would not be surprised if EK contest it. I'd like for them to see it the way you do, but don't think they'll give in without a fight. Maybe not even as far as court, but who knows?

The flight that was impacted was NOT a codeshare flight - It was an Emirates flight from Madrid to Dubai - who operated the onward flight from Dubai is irrelevant
The EC compensation is due based on the delay of flight TO Dubai
The situation is exactly the same as that of Gahan on exactly the same airline
The fact that the delay into Dubai was not 3 hrs 56 miniutes does not somehow make the situation different The ruling explains the rationale on why the appeal by emirates was denied
The whole basis of the appeal was to clarify whether the delay is counted for the flight to Dubai only or whether the delay to final destination counted
The appeal judges ruled that it was exactly as per regulation says - the delay at final destinaton
That the delay into Dubai was not 3 hrs 56 minutes does not take away from that the delay to destination counts
The only thing that matters is what the reason for the delay was and whether it is covered under the regulation

Whatever the actual facts of the EC261 claim, Emirates will just state that the flight delay was outside their control and tell you to get lost. In the air they're good, but their service across the rest of the company is trash. When I had exactly the same situation they simply fed me a different lie each time I emailed them. There's apparently no way a customer can find out the true reason for a delay, so you're out of luck most likely.

No they should not. The MCT (Minimum Connecting Time) is set because airlines should not sell any connections falling below, in this case, 120 minutes. That takes into account reasonable minor delays, which 15 minutes after schedule is. In your case you arrived 75 minutes before the departure of the next flight and Emirates deemed that you would not make the connection.
