Emirates and Flight Cancellation (Entitlements)
 
Hi All,

Not a frequent poster to this site, but observe on a regular basis. I flew with Emirates May/June 16 while traveling around the Emirates and Asia

I had a mixed fare type with me traveling in both Y and J. We left Ireland on the 14th May 2016 while only a couple of days into our travels i receive an e-mail saying our flight EK395 on the 2 June 2016 07.10am would be cancelled and to contact them to book an alternative .

I was flying J on this flight and my companions Y

The options they gave us was either EK379 depart 00.10am either on the 2/3rd June arriving at 03.10am

As we had budgeted for this trip accordingly and booked activities in Dubai with very little time if we flew in a day later we would have to loose our prepaid activities and a days accommodation. If we left on the earlier flight we would loose 1 nights hotel accommodation in Thailand and have to look for accommodation on an early arrival . Trying to sort all this out while trying to travel on the go proved timely and put a downer on our trip.

I asked Emirates if we where to fly in earlier and loose a night in Thailand could they offer us some sort of accommodation until our accommodation would be vacant or access to a place to wait Ie Lounge etc but they said the could do nothing.

In the end we had to loose a night in Thailand by taking the earlier flight, otherwise we would have missed out on our schedule of activities in Dubai as we had only 4 nights planned for Dubai. We had to pay for accommodation on arrival in Dubai and loose a nights paid accommodation in Thailand all what we did not budget for.

Is it tough luck or should i be entitled to any compensation under the Eu rules

This is the kind of case where travel insurance is worth its money. This is a clear case for such a situation and one might say the exact reason travel insurance exists, to insure an unexpected change in travel plans.

You'll 100% be unable to get EK to cover any consequential loss due to their cancellation, EK will never pay for consequential loss.

EU rules apply to non-EU carriers only for flights originating from the EU. I'm not sure what the current situation is as to whether this includes the connection when the connecting point is outside the EU. However in this case it seems you were flying DUB-(DXB)-BKK / BKK-DXB-DUB with a stopover in DXB on the return. EU261 definitely does not apply in this case for the return portion of the ticket.

You may get some Skywards miles if you write in to them regarding your changed return (from Phuket?) although you may have left it a bit late.

Cut down on the wordiness though and don't mention the EU rules.
