Wrongly denied EU261 claim?
Let me preface by saying this is not my first rodeo!
Here's the situation: I was booked on a flight between PMO and MXP, a total distance of under 900km as the crow flies. The flight departed 2:45 late and landed 2:40 late. Under EU261 Article 6(a)(1), it states that flights under 1500km are entitled to 250EUR compensation. EasyJet has denied the, saying the flight delay was "under 3 hours." This is not the law. In fact, I argue this is misinforming the customer of the law, a violation under EU261/2004 Article 14. Now, the question: am I correct? If so, what next? easyJet will just deny the claim until I file with the proper aviation authority, correct? In my case, its ENAC in Italy (it was a domestic flight). Refreshments and communication are required for this delay, but compensation is for > 3 hours is my understanding. Subject to the cause not being "extraordinary".
